Can I Use AI Generated Product Images in Ads?

Overview

You can use AI-generated product images in ads when the selected model’s terms permit the commercial use and the finished ad clears rights, accuracy and platform-policy review. The fact that an API returned an image is not, by itself, advertising clearance. WaveSpeedAI says many model outputs may be used commercially, but its policy directs users to check each model and provider.

Start with the materials you supplied. You need rights to the source product photos, logos, packaging, people and reference designs. Then review the generated image against the real product: color, shape, included accessories, labels and performance cues. A persuasive visual can still be misleading if the item shown is not what customers receive. Retain the prompt, source permissions, route and final edited asset so the marketing team can explain how the creative was made.

WaveSpeedAI’s current terms allocate applicable input and output Customer Data to the customer as between the parties, but do not promise that an output is copyrightable, unique or non-infringing. Model-provider rules and ad-channel policies add separate layers. If an image resembles a competitor’s trade dress or a real person, escalate it before running the campaign.

Treat the API as a production tool and the ad as a claim to be substantiated. For material legal or regulated-product questions, have the appropriate reviewer assess the exact market and campaign; a general API permission cannot replace that review.
