Who Owns Images Generated Through an AI Image API?

Overview

Ownership depends on the API contract, the model provider’s terms and applicable law. Under WaveSpeedAI’s current terms, as between the customer and WaveSpeedAI, the customer owns applicable Customer Data, a category that includes inputs and outputs. That contractual allocation does not guarantee that a generated image qualifies for copyright protection or is free of third-party rights.

Separate three questions before publishing. First, did your team have the right to upload the prompt, photo, logo or reference? Second, what does the API platform say about the generated output and its right to process it? Third, does the underlying model impose additional conditions? WaveSpeedAI’s terms give the platform a limited license to process Customer Data for the service and require compliance with relevant third-party terms. The commercial-use policy also directs users to check the selected model’s terms.

Keep a record of the exact route, applicable terms, input provenance and human edits at the time an asset is approved. For campaigns, review similarity to existing works and the rights of people, brands and products depicted. A model output can be contractually allocated to you and still raise separate copyright, trademark, publicity or advertising questions.

The practical answer is to treat the API contract as one layer of clearance, not the whole clearance decision. Have counsel review high-value or disputed uses under the law that applies to your market. Record the reviewer and date so a later audit can reconstruct the approval decision.
